All prison courtroom cases begin in a magistrates' courtroom, and the vast majority will end there. The decision to refer a query to the ECJ will be made by the court of its personal initiative, or at the request of any of the parties earlier than it. Where a question of European regulation is unsure and there is no enchantment from the choice of a court docket, it is required (besides below the doctrine of acte clair ) to refer the question to the ECJ |
